1. Acceptance of terms
By creating an account or using MazingiraShield's website, dashboard, or field survey tool (the "Service"), you agree to these Terms of Use. If you're using the Service on behalf of an organization, you confirm that you have the authority to bind that organization to these Terms.
2. Description of the service
MazingiraShield provides satellite- and drone-based monitoring of tree-planting sites, a field survey tool for ground verification, vegetation-health classification, IPCC Tier 1 carbon estimation, multi-site dashboards, exportable reports, and tools to track verified payouts to site caretakers.
3. Accounts
You're responsible for keeping your login credentials confidential and for all activity that happens under your account. Tell us promptly if you suspect unauthorized use of your account.
4. Acceptable use
You agree not to:
- Use the Service to upload or process unlawful content
- Attempt to interfere with, disrupt, or compromise the security of the Service
- Process personal data through the Service — including beneficiary payout details — that you don't have the right to process
- Resell, sublicense, or provide third-party access to the Service without our agreement
5. Customer data and ownership
Site, survey, and reporting data you or your organization submit ("Customer Data") remains your property. You grant us a license to host, process, and display that data solely to provide the Service to you. We may use de-identified, aggregated data — for example, regional survival trends across customers — for research, product improvement, and public reporting, without identifying a specific customer or site unless we've agreed otherwise in writing.
6. Accuracy of outputs
Survival rates, vegetation-health classifications, and carbon estimates are generated from satellite imagery, drone surveys, ground verification, and an IPCC Tier 1 allometric methodology. These are estimates, and their accuracy depends on the underlying imagery and field data. Where a site's species mix isn't recorded, the platform falls back to an IPCC tropical broadleaf default and discloses this on the relevant report. MazingiraShield's outputs are intended to support — not replace — your own due diligence, audit, or certification process.
7. Fees
Access to the Service is provided under a separate agreement or order form with your organization, which governs any applicable fees. [Placeholder — update once a pricing model is finalized.]
8. Beneficiary payouts
Where the Service is used to track or facilitate payouts to caretakers or other beneficiaries, your organization — not MazingiraShield — is responsible for the underlying payment relationship, the amounts owed, and compliance with any applicable labor or financial regulations, unless we've agreed otherwise in writing.
9. Intellectual property
The Service, including its software, design, and underlying methodology, belongs to MazingiraShield. These Terms don't grant you any rights to our trademarks or branding beyond what's needed to use the Service as intended.
10. Termination
We may suspend or terminate your access for a breach of these Terms. You may stop using the Service at any time; some data export or retention obligations may continue to apply afterward.
11. Disclaimers and limitation of liability
The Service is provided "as is." To the extent permitted by law, MazingiraShield disclaims warranties of merchantability, fitness for a particular purpose, and non-infringement, and isn't liable for indirect, incidental, or consequential damages arising from use of the Service.
12. Governing law
These Terms are governed by the laws of Kenya, and any dispute is subject to the jurisdiction of the courts of Kenya, unless we've agreed otherwise in writing.
13. Changes to these terms
We may update these Terms from time to time. Continuing to use the Service after a change takes effect means you accept the updated Terms.
